Acceptance and eligibility

These Terms of Service (“Terms”) represent an agreement between you and Ecommerce Scale Inc. (“Shop Pet Direct,” “we,” “us,” or “our”) governing your access to our website, design tools, and customized pet product store.

By browsing our website, using our interactive design tools, or placing an order, you agree to these Terms. If you do not agree to these Terms, you must not use our website or purchase items from our store. You must be at least 18 years old or the legal age of majority in your jurisdiction to place orders on Shop Pet Direct.

Custom products and photo upload licenses

When you upload photographs or enter pet name text on Shop Pet Direct to create custom products, you agree to the following conditions:

  • Limited license for production: You grant Ecommerce Scale Inc. and our manufacturing partner, Printful, a non-exclusive, royalty-free, limited license to host, format, crop, style, and reproduce your uploaded content solely for the purpose of creating and shipping your custom order.
  • Ownership warranty: You represent and warrant that you own or possess all necessary copyrights, trademarks, and permissions for the images you upload. You agree not to upload images that infringe upon any third party’s intellectual property or privacy rights.
  • Content standards: We reserve the right to decline any order containing images or text that are unlawful, defamatory, abusive, threatening, or obscene.
  • Marketing restriction: We will never publish, license, or display your pet’s images in marketing campaigns, product listings, or advertisements without your prior written permission.

Design previews and resolution checks

Before you place a custom order, our online customization tools help you check your design:

  • Automatic resolution validation: When you upload a photograph, our upload tool checks its pixel dimensions and rejects images that fall below the minimum resolution needed for printing.
  • Customer digital preview: Before adding an item to your cart, our website generates a digital preview of your design showing the cropped image, selected portrait style, and optional pet name. You are responsible for verifying the positioning of the image and the spelling of any pet name text before completing checkout.
  • Automated print handoff: Once payment succeeds, the print file generated from your preview is sent automatically to our print partner, Printful, for production.

Orders, cancellations, and pricing policies

Because custom pet keepsakes are manufactured to your personal specifications, specific commercial rules apply:

  • Order changes and cancellations: Orders are sent to Printful and confirmed for production automatically as soon as payment succeeds. If you need to change or cancel, email us right away at [email protected] with your order number. We can change or cancel only until Printful starts making it, which can be within a few hours; after that we can’t stop it.
  • Pricing errors: In the event that a product is mistakenly listed at an incorrect price, we reserve the right to cancel the order and provide a full refund.
  • Domestic fulfillment: We currently manufacture and ship exclusively to addresses within the United States.
  • Returns and refunds: Because custom photo products cannot be resold, we cannot accept returns for buyer’s remorse. If an item arrives damaged, defective, or misprinted, we provide a free replacement or refund when reported within 30 days of delivery, as described in our returns policy.

Intellectual property and site conduct

All website graphics, branding, text, layout designs, and software tools on Shop Pet Direct are the property of Ecommerce Scale Inc. and are protected by United States and international intellectual property laws. You agree not to scrape, copy, or redistribute website assets without written authorization.

Limitation of liability

To the maximum extent permitted by applicable law, Ecommerce Scale Inc., its officers, directors, employees, and print partners shall not be held liable for any indirect, incidental, punitive, or consequential damages resulting from your use of the site or customized products.

Our total aggregate liability for any claim arising under these Terms shall not exceed the total amount paid by you for the specific product purchase giving rise to the claim.

Governing law and jurisdiction

These Terms shall be governed by and interpreted under the laws of Minnesota, without giving effect to conflict of law principles. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the state or federal courts located within Minnesota.
